Drunk Driving – Driving Under the Influence

I drank too much alcohol and then drove my vehicle. Unfortunately, I got into an accident and seriously injured my passenger. I was arrested and charged with Felony Driving Under the Influence Vehicle Code Sections 23153(a), 23153(b). My blood alcohol level was over twice the legal limit. I was facing almost 4 years of prison for this offense. I hired Attorney Will Bruzzo to represent me on this matter. Mr. Bruzzo has practiced criminal law [to include Driving Under the Influence, Drunk Driving] for over 30 years and is very familiar with the Judges and District Attorney in Orange County. Mr. Bruzzo then had me attend residential and out-patient alcohol treatment. I was pulled over for not having license plates on my car. The reason for that was because it was new. When the Officer pulled me over, he claims to have smelled marijuana and he began to ask me questions. I admitted to smoking marijuana earlier in the day. The Officer then started an investigation to see if I was driving under the influence of a drug, that is Marijuana, under Vehicle Code Section 23152(f) [Driving Under the Influence of a Drug], a misdemeanor. The Officer had me do field sobriety tests (stand on one leg, stand with feet together, walk 9 steps, finger to nose) which were recorded on video. He claimed that I did not do the tests well and I was subsequently arrested for driving under the influence of a drug -Marijuana under vehicle Code Section 23152(f). A blood test revealed that I did have Marijuana in my system at the time of driving [12 nanograms per milliliter of Marijuana]. I hired Attorney Will Bruzzo to represent me. Mr. Bruzzo has represented me in several matters over the years and he has consistently gotten good results to include dismissals of cases and he has had old cases sealed and destroyed for me among other things. Mr. Bruzzo went to court for me and obtained the evidence to defend my case. He reviewed the recording of my field sobriety tests and felt that my performance did NOT SHOW AN INTOXICATION LEVEL THAT WOULD IMPAIR DRIVING. However, normally the Prosecutor will not dismiss a case for Vehicle Code Section 23152(f) on those grounds and will send the matter to trial and let the jury decide. However, Mr. Bruzzo was able to persuade the Prosecutor that this was a very bad case for them based on my good field sobriety tests and they agreed to DISMISS the Vehicle Code Section 23152(f) charge without going to trial!!! I was charged with Vehicle Code Section 23140(a) for driving a vehicle while having alcohol in my system and for being under age 21. In addition to facing consequences in the court I was also subject to a DMV hearing and losing my license for up to a year. I hired Attorney Will Bruzzo to represent me. I was arrested for driving under the influence [Vehicle Code Sections 23152(a), 23152(b) and 23152(g)-driving under the influence of drugs and alcohol]; the detention led me to be charged with sales of marijuana [H&S 11359(b)] after I consented to a search of my cellular phone and possession of methamphetamine [H&S 11377(a)] after I consented to a search of my car. I was charged with Drunk Driving under Vehicle Code Sections 23152(a) and 23152(b); I went out for drinks with friends and then got into an accident. I was concerned about having a conviction for this charge on my record and the problems it might costs me in my job. The initial breath alcohol level I had was above a .09 which is above the legal limit. However, the accident occurred in a remote area and by the time they got me back to the station for another breath test my blood alcohol level was just below the limit of .08. I hired Mr. Will Bruzzo to represent me as he was referred by a friend who got a very good result with him on another case. I was charged with Driving under the influence per Vehicle Code section 23152(a) and Vehicle Code section 23152(b) for a second drunk driving offense. My minor child was also present in the car so I was also charged with Penal Code section 273a (a) child endangerment. I hired Attorney Will Bruzzo to represent me. Normally a second time drunk driving offense requires at least 60 days in jail if convicted. In addition the child endangerment charge requires a 52 week class if convicted [and could require additional jail]. Mr. Bruzzo argued my case with the District Attorney and demonstrated that aside from this incident I am a committed father and have had the same job for a long time. In the end he managed to get the child endangerment charge (Penal Code Section 273a (a) DISMISSED and I admitted to a vehicular code enhancement that does not require a class. Also, instead of getting jail I did an outpatient program which helps me keep my job and support my child. I was charged with a third drunk driving offense two years after being convicted of two previous drunk driving offenses [Vehicle Code Section 23152(a), 23152(b)]. A third drunk driving offense is a minimum of 120 days jail. After appearing in court once I did not appear again and a warrant went out for my arrest. I was arrested and charged with Driving under the Influence of alcohol (Vehicle Code Section 23152(a) and driving under the influence with a blood alcohol level above .08 (Vehicle Code Section 23152(b). My blood alcohol level at the scene was .11 [3/10ths of percent over the limit) and a .09 [1/10th of a percent over the limit] at the police station. The police contacted me because my car was stopped in a traffic lane and I was blocking traffic. I was charged with a third case of drunk driving (Vehicle Code Section 23152(a)); I had two previous convictions for drunk driving which had occurred within months of each other about a year previous. The District Attorney wanted 270 days of jail on my new case. I hired attorney Will Bruzzo to represent me because he had represented me in the past and always did a good job. I was charged with Driving Under the Influence (Vehicle Code Section 23152(a)) and Driving Under the Influence with a blood alcohol level of .08 or greater (Vehicle Code Section 23152 (b)) both misdemeanor offenses. This crime carries up to a maximum of 6 months in jail. I was most concerned with keeping my record clean and maintaining my driving privilege. Mr. Bruzzo went to court for me several times (I did not have to appear) and he attempted to negotiate the matter with the District Attorney. As part of that process he conducted a thorough investigation into how well the breath testing devices were working. When the District Attorney refused to dismiss the case Mr. Bruzzo set the matter for trial. In the end Mr. Bruzzo proved to be a very good trial attorney as the jury came back NOT GUILTY on all charges. I was originally alleged to have committed felony driving under the influence (V.C. 23152 (a)). The police were called to the scene because I was involved in an accident with another individual who experienced minor injuries; the police then arrested me for suspicion of being under the influence. According to the police I had a blood alcohol level of .15. Attorney William W. Bruzzo was referred to me by another attorney as being very experienced in criminal law and drunk driving cases. Even before my case went to court Mr. Bruzzo spoke to the District Attorney who was going to file my case and convinced her to file my case as a misdemeanor. After getting the case reduced to a misdemeanor Mr. Bruzzo then convinced a Judge to release me on my own recognizance which means that I did not have to pay bail. M r. Bruzzo then set to work litigating my case by requesting the necessary information from the District Attorney and by having an independent DUI Drug/Alcohol expert evaluate my case. Mr. Bruzzo then negotiated with the District Attorney but was unable to come to a satisfactory agreement so my case was set for trial. Mr. Bruzzo filed pre-trial motions and argued them prior to trial in a further attempt to put my case in the best possible light before the jury. Mr. Bruzzo proved to be an excellent trial attorney; at the end of the trial 11 of 12 jurors voted to find me NOT GUILTY and the Judge then dismissed the case. I truly believe that but for Mr. Bruzzo’s efforts that started prior to my case even going to court the result could have been different. I was arrested for driving under the influence of alcohol in the County of Orange (vehicle code section 23152 (a) (b)). My blood alcohol level was a .20. Then a month later I was once again arrested for drunk driving once again in the County of Orange and charged with driving under the influence (vehicle code section 23152 (a) (b)). I refused to take the chemical test on the second arrest. I then failed to appear on either case and they both went to warrant. Later, I was referred to Attorney William W. Bruzzo by an individual familiar with the attorneys in Orange County and I ended up hiring him to recall the warrants and resolve the cases. Mr. Bruzzo set to work on my cases and began negotiating with the District Attorney. Mr. Bruzzo is highly experienced in drunk driving cases and criminal law. He ended up filing a motion on my behalf for each case and argued it in front of the Judge with the District Attorney opposing. In the end the court DISMISSED both cases because Mr. Bruzzo argued that the District Attorney failed to adequately perform its responsibilities in my cases. This was an amazing result because I was looking at up to 1 year in jail. Not only did I not have to do jail but I also do not have to worry about having a conviction on my record and I NEVER APPEARED IN COURT. I was arrested and charged with Driving Under the Influence (DUI); my blood alcohol level was a .10. Every person who is arrested for DUI in the state of California is subject not only to court proceedings but also a hearing with the Department of Motor Vehicles (DMV). I hired Attorney William W. I was especially concerned with the DMV matter because the DMV can actually cause you to lose your license for a period of time whereas the court usually does not on a first time DUI. Mr. Bruzzo then appeared at the DMV hearing without me being present and ended up getting the suspension of my license SET ASIDE (Dismissed). This means that I will not lose my driving privilege. Mr. Bruzzo managed to do this even though my blood alcohol level was above the legal limit. Without Mr. Bruzzo’s skill and knowledge I would have lost my license and it would have it made it more difficult for me to work. I would highly recommend him for any DUI or DMV matter.
