THREATS/ “STRIKE” CASE (California
Penal Code Section 422, 667 AND 1192.7)
The Client was charged with felony Criminal Terrorist
Threats (Penal Code Section 422) out of Orange
County Superior Court. This charge carried a maximum of
3 years in state prison; however, the client also had a
prior strike offense of residential burglary
which doubled his exposure to 6 years. In addition the
client had been to state prison on three prior occasions
the last one being 5 years in duration. Each state prison
prior increased the sentence by one year. As a result the
client was looking at a 9-year total sentence.
In the very first negotiation session with the District
Attorney and the Judge he was able to convince the Judge
to reduce the felony terrorist threat to a misdemeanor.
By doing this Mr. Bruzzo removed the effect of the prior
strike offense and the prison enhancement. In the end the
client was sentenced to 20 DAYS, CREDIT TIME SERVED
AND RELEASED. Mr. Bruzzo’s familiarity with
the court and the personnel who work there made a huge
difference in the client’s case.
