Grand Theft (Penal Code Section 487)

A theft of item(s) of a value in excess of $950.00 can be charged as a felony and is known as Grand Theft (Penal Code Section 487); it can carry a maximum of up to three years in state prison. However, it is extremely rare anyone goes to jail for this offense. This charge is known as a wobbler and can be reduced to a misdemeanor. Once reduced to a misdemeanor it can then be dismissed with the Court Diversion Program [ Penal Code Section 1001.95] or a District Attorney program. There are many, many ways to get theft charges dismissed. Prosecutors are less concerned with property offenses then with crimes against people, which gives the Grand Theft charges more options for a good disposition.

Residential Burglary (Penal Code Sections 459-460)

Any person who enters the home of another with the intent to steal or commit a felony is guilty of burglary in the first degree. This carries a maximum punishment of up to 6 years in prison although first time offenders usually do less than 1 year in county jail. Notably, although residential burglary does not appear violent in nature it is considered a “strike” offense. It is very important to be represented by an attorney experienced in these matters.
