<p>A California Court has found that BB Guns, that is air powered guns that shoot ball bearing type projectiles or pellets, may be considered deadly weapons under Penal Code Section 245(a) (1)<a href="http://www.bruzzolaw.com/criminal-charges/assault-battery.html" target="_blank" rel="noreferrer noopener">&nbsp;[Assault with a Deadly Weapon]</a>. Previously, the conventional wisdom was that BB guns were not thought of as equal to firearms, but this holding appears to blur the line.</p>



<p>In the recent case, People v. Brown, the facts of the case showed that the victims were actually shot with the BB gun and suffered small red welts to parts of their bodies. Despite the fact that the projectiles did not penetrate the skin of the victims, the court held that there was the potential of significant damage if the projectile hit the eye of the victim. Based on that potentiality, the court held that use of a BB gun qualified as assault with a deadly weapon. This is especially pertinent given that the holiday season is upon us, we all remember fondly that Ralphie from&nbsp;<em><strong>A Christmas Story</strong></em>&nbsp;wanted a Red Ryder BB gun, but was discouraged by his elders because he “would put an eye out.” Well, in this case Ralphie is still out of luck because now the California Appellate courts have also discouraged the use of BB guns because they can put an eye out. <p>The Los Angeles Police Department’s robbery and homicide division are investigating three stabbing incidents. One incident occurred in Santa Monica the other two in Los Angeles. Three homeless people were stabbed by one suspect. According to the Los Angeles Times, police said they were searching for David Ben Keyes who has been missing from Santa Barbara. Now police state that the suspect’s real name is Courtney Anthony Robinson. The three victims survived the attacks. Two weapons have been recovered each from a different crime scene. One a black kitchen knife used in the Hollywood incident where a homeless woman was stabbed while she slept. The other was a hunting knife from the first attack on July 4th, the victim had been struck between the shoulder blades. The knife was still inserted in his back when he was helped. Notes have been left at all three sites. A note with the words “death warrants” and the suspect’s signature have been confirmed at two of the crime scenes.</p>

<p>Shazer Fernando Limas has been charged with the stabbing death of the mother of his sons in Anaheim, Orange County California. His two children, one year old Fernando and three month old Emanuel are missing. Lima is being charged with their deaths as well. There are no clues suggesting where the boys are or if they are still alive. Relatives and authorities had been searching for Contreras and hoping to hear from her. Her body was found on April 25th next to a gutter covered by a tarp. Authorities are stipulating that Limas had stabbed her and their sons to death on April 14th. A cleaning crew discovered blood under the carpet, on the walls and on the floor at Limas’ apartment. He had moved out on April 28th and had been arrested on May 3rd after a high-speed chase that started near John Wayne Airport and ended near the San Clemente Border Patrol checkpoint. He faces sentencing enhancements for multiple murders and use of a deadly weapon which can result in his being sentenced to death.</p>

<p>Investigators have arrested gang members and their associates in the Harbor Gateway and Wilmington area as part of a multi-agency operation. Federal agencies such as the ATF, DEA and local and state law enforcement completed a two and a half year investigation. Agents worked within the criminal organization, using informants and undercover agents. Within that time drugs were sold and transported as well as fire arms transactions made. Cocaine, marijuana, methamphetamine, crack cocaine, and heroin were the drugs sold by the gangs. Members of the Dodgetown Crips and Rancho San Pedro were taken into custody. Federal grand jury indictments also charged some individuals with immigration violations, methamphetamine distribution and illegal weapon sales. The operation was an attempt to tackle the criminal activities that center in the Harbor area and reach out to neighboring cities.</p>

<p>On March 29th, at the Harbor Justice Center in Newport Beach, Orange County, a 16 year old Laguna Beach teen was arraigned and is facing assault with a deadly weapon charges for acts against three other teens and two minors. According to the Orange County Register authorities explained that the teens were arguing through texts, emails and the networking site Facebook prior to the stabbing. There was no elaboration on what the argument was about. Allegedly Michael Wilson and one teenage victim agreed to meet at Wilson’s house. There, Wilson took a carving knife and stabbed the victim in the stomach. Two friends who tried to help the victim, Julian C., suffered injuries as well. Wilson is facing three counts of assault with a deadly weapon, <a href="http://www.bruzzolaw.com/criminal-charges/assault-battery.html" target="_blank" rel="noreferrer noopener">Penal Code Section 245(a)(1)</a> with other than a firearm and Penal Code Section 12022.7a for three enhancements resulting from inflicting great bodily harm. Wilson is out on bail.</p>
