<p>Jorge OCampo, a 21-year old documented gang member has been arrested on charges of vehicular manslaughter and felony&nbsp;<a href="http://www.bruzzolaw.com/criminal-charges/hit-and-run.html" target="_blank" rel="noreferrer noopener">hit and run</a>. On August 22, 2013 he allegedly ran a stop sign and hit another vehicle killing two of the occupants. It was about 11:00 am when the accident occurred and there is no evidence that alcohol or drugs were involved. Mr. OCampo checked on the victims afterward but walked away from the scene before the police arrived while speaking on his cellular phone according to witnesses. He later turned himself that night.</p>



<p>In California, an individual can be charged with manslaughter if their conduct, while not intentional, was so reckless as to amount to criminal negligence. Criminal negligence is acting without a reasonable regard for human life or indifference to the consequences of that act. In this matter Mr. Ocampo is alleged to have run a stop sign and run into the victims’ vehicle.</p>



<p>Vehicular manslaughter charges (Penal Code Section 192(b)) can be alleged in two different ways: The first way is that a person may be not have broken any law or traffic infraction but may have been doing something legal (driving down the street) but still acted with criminal negligence (not paying attention to what is in front of him). In so doing he might run over a child who was in the street in plain view. This could lead to a charge of vehicular manslaughter.</p>



<p>The more commonly prosecuted case is when a person breaks a vehicle code section like the drunk driving law, speeding law or as is the situation here, run a stop sign. Any violation of the law which led to the death of someone can be the basis for a vehicular manslaughter charge if the death of the victim was a necessary and probable consequence of breaking that law or infraction.</p>



<p>In this case, the Prosecution may be hard pressed to show that running a stop sign is something that the Defendant should have known directly, naturally and probably would result in death. For example, what if the Defendant is very familiar with the area and the stop sign is in a remote place with little traffic? In that situation he could argue the deaths of these individuals was not a probable consequence. On the other hand, someone who drives on the freeway drunk would probably be seen as acting sufficient recklessly to be found criminally negligent. Vehicular manslaughter carries a maximum sentence of 6 years in prison.</p>



<p><a href="http://www.bruzzolaw.com/hit-and-run/hitandrun-defenses.html" target="_blank" rel="noreferrer noopener">Hit and Run (Vehicle Code Sections 20001-20003)</a>&nbsp;involves any situation where the Defendant has an accident and fails to remain at the scene and exchange information with the other party OR fails to call the authorities to report the matter. Generally speaking an accident must be reported within two hours. Most Hit and Run cases are misdemeanors as they involve property damage only. However, an individual who flees the scene after killing people in a vehicular manslaughter situation faces an additional 5 years in prison if he does not stay at the scene to talk with authorities and render aid to the victims if possible. The idea being that the victims of the crime may benefit from the Defendant calling authorities and/or the ambulance and otherwise rendering aid.</p>

<p>An Orange County man was sentenced to 4 years in prison for killing a pedestrian who was walking in the crosswalk. Martin Kuehl, the driver of the vehicle, was texting while driving and was convicted of vehicular manslaughter with gross negligence (California Penal Code Section 192).<br><br>Kuehl pleaded with the judge to not send him back to prison as he has been incarcerated previously for theft. But because the jury found that the accident happened due to gross negligence on Kuehl’s part, the judge was hesitant to sentence him to anything less than prison. A devastated Kuehl said “there’s not a day that passes that I don’t think of the consequences…that I caused this horrible accident.”<br><br>Kuehl’s defense during the trial was that there was a glare on the windshield which caused him to not see the victim. He denied texting while driving and said he only text messaged while stopped at a light.</p>

<p>Charges have not yet been filed by the Orange County District Attorney against a La Habra police officer who crashed into a civilian vehicle killing the couple inside. The crashed occurred in September when Officer Nancy Garcia was responding to a call regarding a parolee search and went through a red light. Susanne Antuna died at the scene and her husband Charles Antuna died at UCI Medical Center the following morning. A civil suit has been brought on behalf of the couple’s four surviving children. According to the CHP investigation Garcia was driving at a speed of 65mph; they have recommended that she be charged with vehicular manslaughter. See Penal Code Section 192.5.</p>

<p>On April 25 2009 two motorcyclists were on the 241 Toll Road in Orange County going over 100 mph after midnight. One of the motorcyclists Blaise Aaron Meadows crashed into an Alpha Romeo, the driver Andrew Parker later died due to blunt force trauma. Meadows was taken to the hospital while the other motorcyclist Daniel Cody Burkett left the scene. Meadows pled guilty to one felony count of vehicular manslaughter (Penal Code Section 192) and will be sentenced on July 30, 2010. Burkett will be arraigned on February 16 and is being charged with one count vehicular manslaughter by unlawful act, gross negligence (Penal Code Section 192), one misdemeanor count of reckless driving (Vehicle Code Section 23103) and a sentencing enhancement for fleeing the scene of a crime. The sentencing enhancement adds more time to his prison term but is not considered a charge. The gross negligence specification to the vehicular manslaughter charge could be for driving over 100mph.</p>

<p>An 18-year-old driving a gray Ferrari crashed into a tow truck killing his passenger on December 24, 2009 in Newport Beach, Orange County, California. Luicci Nader, the driver, remains in critical condition and is unable to speak to authorities after having lost control of his vehicle due to excessive speed. No alcohol was involved in the accident; however, Nader still faces possible charges of manslaughter if he recovers.<br><br>Under California Penal Code Section 192, manslaughter is “he unlawful killing of a human being without malice.” There are three types of manslaughter- 1) Voluntary, 2) Involuntary, and 3) Vehicular. The above case would most likely fall under the category of vehicular manslaughter as the driver was driving the vehicle while unlawfully speeding and it resulted in the death of his passenger. Because Nader was grossly negligent, he could be convicted for vehicular manslaughter and receive up to 6 years in prison.</p>
