Three men are going on trial for the deaths of two Irvine residents. The victims were the parents of a young woman who was dating one of the Defendants. Another daughter suffered serious injuries in the attack. The parents were found dead, their bodies showed evidence of being stabbed and beaten. The remains were found at a park in Irvine early in the morning; they had been set on fire. Officials explain that the victims were targeted by the boyfriend of the youngest member of the Dhanak family, who was unharmed and not at the house during the incident. Her parents had told her to end the relationship with Iftekhar Murtaza, who they did not approve of. Vitaliy Krasoperov, a friend of Mr. Murtaza, will go on trial for aiding and abetting, since according to prosecutors he participated in the planning and cover up of the incident. His defense attorney will argue that his client was at home recuperating from a motorcycle accident. He is being charged with conspiring to commit murder, two counts of murder, one count of attempted murder, sentencing enhancements for multiple murders, murder during a commission of a burglary, and murder during a kidnapping. The third defendant, Charles Murphy is a long time friend of Murtaza and faces life in prison with out the possibility of parole for similar charges. Penal Code Sections 664-187.

A controlled burn is planned for a house in Escondido where a significant amount of explosives and explosive materials were found. The owner of the house, who is an out of work software consultant, was taken into custody. During his police interview he stated that he had robbed three San Diego banks. There is no report on the suspect’s motive for having such dangerous materials in his possession. The suspect is George D. Jakubec a 54-year old on probation for a burglary conviction. Authorities investigated the residence after a landscaper was injured while stepping in the backyard. The worker stepped on a land mine type device and the detonation caused him cuts, burns, and bruises. Neighbors will be evacuated and a portion of Interstate 5 will be closed during the burn. Also agencies will closely monitor weather patterns in order to minimize complications during the burn. The operation is receiving assistance from the state since Governor Schwarzenegger declared a state of emergency according to the Los Angeles Times.

30-year-old Fidel Galindo was arrested on October 22nd for attempting to break into an off-duty deputy’s SUV in Laguna Niguel. The deputy chased Mr. Galindo down after seeing him near his SUV. When he finally caught up with him, he held him until Orange County Sheriff’s Department deputies arrived.

Mr. Galindo was booked and is currently held on a $20,000 bail for attempted auto theft. California has two laws which address the theft of automobiles – Grand Theft Auto and Unlawful Taking/Driving of a Vehicle (“Joyriding”). Both may be charged either as a misdemeanor or felony depending on the facts of your case and if you have any similar prior convictions.

Penal Code 487(d) (1) defines grand theft auto (GTA) as intent to permanently deprive the owner of the vehicle. This offense is typically prosecuted as a felony and subjects you to anywhere from 16 months to four years in State Prison as well as up to $10,000 in fines. The second law, Vehicle Code 10851 (“Joyriding”), requires intent to temporarily deprive the owner of the vehicle. This offense is typically charged as a misdemeanor and subjects you to a maximum of 1 year county jail.

If Mr. Galindo had broken into the car before he stole it, he may additionally be charged with auto burglary under Penal Code 459. However, if an experienced criminal defense attorney can prove that you didn’t intend to deprive the owner of his/her car, you can’t be convicted of GTA or vehicle theft.
