Disorderly Conduct

Penal Code Section 647(f) prohibits a person from being willfully under the influence of alcohol or drugs AND unable to care for himself OR interfering with a public sidewalk, street or other public way.

In order to arrest or convict an individual of this crime the officer does not have to administer a field sobriety test or conduct a breath or blood test. The basis for the arrest can be the observations of the officer alone.

The maximum sentence for this crime is 90 days of county jail; however, with a skillful attorney usually jail can be avoided altogether UNLESS the individual has a history of drug/alcohol related arrests or convictions. In addition, Mr. Bruzzo has managed to get some cases dismissed when the Defendant completes an alcohol/drug education class.
