Assault With Force Likely to Produce Great Bodily Injury

I was charged with Penal Code Section 245(a)(4) [Assault with Force Likely to Produce Great Bodily Injury] a felony; Penal Code Section 243(d) [Battery with Serious Bodily Injury] a felony; Penal Code Section 25850(a)/(c)(7) [Carrying Loaded Firearm in Public], a Misdemeanor and Vehicle Code Sections 23152(a)/(b) [Drunk Driving] as Misdemeanors. I was also charged with Penal Code Section 12022.7(a) an enhancement for Great Bodily Injury] [Defendant was looking at maximum of 9 years for these offenses] I hired Attorney Will Bruzzo to represent me. I had battled mental health issues for a few years and Mr. Bruzzo felt the Mental Health Diversion program [Penal Code Section 1001.36] would be a good fit for me. However, because I was charged with Drunk Driving Offenses, I was not eligible for the program. Mr. Bruzzo was able to the Drunk Driving Offenses dismissed in negotiations with the District Attorney. He then had me evaluated for mental health issues and a report was drafted. Mr. Bruzzo then filed a Petition to get me into Mental Health Diversion and I WAS ACCEPTED. I must follow a treatment plan for about 12 months. When I finish the treatment, the case will be DISMISSED [Defendant never spent time in jail and will be eligible to seal his record] I never even entered a guilty plea. I was charged with Assault with a Deadly Weapon under Penal Code Section 245(a) (1) and an enhancement for Great Bodily Injury under Penal Code Section 12022.7(a).
