Battery With Serious Bodily Injury

I was charged with Penal Code Section 245(a)(4) [Assault with Force Likely to Produce Great Bodily Injury] a felony; Penal Code Section 243(d) [Battery with Serious Bodily Injury] a felony; Penal Code Section 25850(a)/(c)(7) [Carrying Loaded Firearm in Public], a Misdemeanor and Vehicle Code Sections 23152(a)/(b) [Drunk Driving] as Misdemeanors. I was also charged with Penal Code Section 12022.7(a) an enhancement for Great Bodily Injury] [Defendant was looking at maximum of 9 years for these offenses] I hired Attorney Will Bruzzo to represent me. I had battled mental health issues for a few years and Mr. Bruzzo felt the Mental Health Diversion program [Penal Code Section 1001.36] would be a good fit for me. However, because I was charged with Drunk Driving Offenses, I was not eligible for the program. Mr. Bruzzo was able to the Drunk Driving Offenses dismissed in negotiations with the District Attorney. He then had me evaluated for mental health issues and a report was drafted. Mr. Bruzzo then filed a Petition to get me into Mental Health Diversion and I WAS ACCEPTED. When I finish the treatment, the case will be DISMISSED [Defendant never spent time in jail and will be eligible to seal his record] I never even entered a guilty plea. I was charged with 4 counts of Penal Code Section 245(a) (1) [Assault with a deadly Weapon] and 1 count of Penal Code Section 243(d) [Battery with Serious Injury] and Penal Code Section 314(1) [Indecent Exposure] as a misdemeanor. I was charged with a Felony Penal Code Section 243(d), Battery with Serious Bodily Injury; this offense carries up to 4 years in prison. Additionally, I had a “strike” prior from many years ago which would have doubled my potential sentence to 8 years. While I did hit the victim one time, it was in self-defense as I was desperately trying to stop him from doing serious injury to both of us. I never pled guilty, never suffered a conviction and never served any jail for this offense. I was involved in a fight in Orange County where basically I thought these two guys were about to hit me so I hit them first, one time each. One of the guys hit his head on the concrete floor when he went down and cracked his head open- he ended up being hospitalized and he went into a coma although he eventually fully recovered. It was my belief from the beginning that I had been acting in self defense even though I had hit the guys first. I explained it all to the police. I was facing 13 years of prison for these offenses. These offenses are considered strike offenses. Also, I had been previously convicted of a misdemeanor charge for an altercation a few years previous. I hired Attorney Will Bruzzo to represent me because of his familiarity with the courts and district attorneys in Orange County; also, Mr. Bruzzo has had extremely good results with these types of cases. Mr. Bruzzo managed to get the District Attorney to offer me a misdemeanor with no jail time but I felt that I was truly innocent of these charges since the other guys were the aggressors and it turned out they were also highly intoxicated.
