Child Abuse / Endangerment

I was involved in a domestic altercation with two members of my family that incidentally got mildly physical. One of my family members made up that I had done something to her. Despite little physical evidence I was charged with Penal Code Section 245(a) (4) [Assault with Force Likely to Produce Great Bodily Injury], Penal Code Section 273a (a), [Child Abuse] and Penal Code Section 273.5 [Domestic Violence]. I was looking at up to a year in custody for these offenses. In addition, I was subjected to a Protective Order which prevented me from seeing my family or even going to my home for the duration of the case. This was all very upsetting for me. A friend helped me research lawyers and we met with and hired Will Bruzzo. Mr. Bruzzo gave us a plan on how to deal with the allegations which he had successfully used in previous cases. He had his private investigator take statements from my family members and then took those statements to the District Attorney. Based on those statements the District Attorney DISMISSED ALL THE CHARGES and TERMINATED the Protective order. I was charged and arrested for Penal Code Section 243(e) (1) [Domestic Violence] and Penal Code Section 273a (b) [Child Abuse/Endangerment, Cruelty to a Child] for what was essentially a verbal dispute between myself and my spouse and one of my children. I was charged with Penal Code Section 273a (b), Child Endangerment for striking a three year old in the face and leaving a mark. This was totally out of character for me and not representative of who I am as a person. [I admitted to the offense to the mother of the child] A conviction for this offense would have destroyed my career and made future job opportunities very limited. I brought my two year old child to the store in my car. The child fell asleep in the back of the car and I forgot about him. The police allege that I left the child unattended in the rear of the car for over 30 minutes. I was subsequently charged with Penal Code Section 273 a (b), Child Abuse and Endangerment. I was charged with Driving under the influence per Vehicle Code section 23152(a) and Vehicle Code section 23152(b) for a second drunk driving offense. My minor child was also present in the car so I was also charged with Penal Code section 273a (a) child endangerment. I hired Attorney Will Bruzzo to represent me. Normally a second time drunk driving offense requires at least 60 days in jail if convicted. In addition the child endangerment charge requires a 52 week class if convicted [and could require additional jail].
