Lewd Conduct in a Public Place

I was charged with Penal Code Section 314(1) [Indecent Exposure] and Penal Code Section 647(a) [Soliciting Another to Engage In Lewd Conduct]. It was alleged that I was masturbating with the intent to offend another person. In addition to looking at [up to] one year in jail I was looking at lifetime registration as a sex offender. Two different witnesses alleged that I was masturbating [in public] and one told the police that I had tried to engage her while I was masturbating. My first attorney did nothing for me. So I fired him and hired Attorney Will Bruzzo. Mr. Bruzzo made contact with the witnesses and discovered serious inaccuracies in the police report. He then spoke with the District Attorney who agreed to DISMISS the Penal Code Section 314(1) charge. [That charge requires lifetime sex offender registration]. I pled guilty to a Penal Code Section 647(a) charge; I was not sentenced to any additional jail time. I am very happy with this result because I do not have to register as a sex offender and I was given credit for time served in jail. I was charged with a violation of Penal Code Section 647(a) [Engaging in a Lewd Act in Public] I was looking at up to 6 months in jail. An undercover police officer claimed that I was engaging in a lewd act with another individual. I denied this occurred. But it was my word against the police officer.
