Possession of Controlled Substance [Health and Safety Code Sections 11377(a) and 11350(a)]

I was charged with Possession of a Controlled Substance [Methamphetamine] under Health and Safety Code Section 11377(a) and Possession of Paraphernalia under Health and Safety Code Section 11364(a) [ ]. Unfortunately, I have a 20-year history of illegal drug use and more than 10 previous misdemeanor and felony convictions for Possession of a controlled substance and other crimes. The District Attorney offered me 1 year (365 days) in jail. I then hired Attorney Will Bruzzo to represent me. I was charged with Health and Safety Code (H&S) section 11378 [Possession for Sales of a Controlled Substance], H&S section 11379(a) [Sales/Transportation of a Controlled Substance], H&S section 11350(a) [Possession of a Controlled Substance], H&S section 11375(b)(2) [Possession of a Designated Substance] and H&S section 11364(a) [Possession of Paraphernalia]. I was looking at up to 5 years in prison for these offenses. I also had a prior Drug Sales conviction for which I was sentenced to State Prison [one year previous] AND I had two other Sales cases pending. I hired Attorney Will Bruzzo to represent me. She also pled guilty to a Misdemeanor Battery charge, Penal Code Section 242 and was put on probation and required to complete community service and pay fines and fees. When it became clear that she was having a difficult time in California we had her come home to the support of friends and family. Unfortunately, she picked up an additional violent charge in her home state that resulted from her mental health and substance abuse issues. She was in considerable need of a very structured court sponsored treatment in her home state, but her problems in California made her ineligible for consideration for the special treatment court. Specifically, she had 3 cases that had gone to WARRANT status because she had failed to appear and because she had failed to comply with terms of probation. I researched to try and find the right attorney for her from my home in the Northeastern part of the country. I had two prior convictions for possession of a controlled substance and various other arrests and convictions for drunk driving and theft cases. I was charged with Possession for Sale of a Controlled Substance (Health and Safety Code Section 11378) [Methamphetamine] and Sale or Transportation of a Controlled Substance (Health and Safety Code Section 11379) [Methamphetamine]. I was looking at 5 years in prison for these offenses. I was stopped for a traffic matter by a police officer who then began to search my vehicle where he eventually found 908 grams (2 lbs) of Methamphetamine. [The officer had detained the Defendant too long for the purposes of a traffic stop AND the consent for the search was not validly given because the request for permission to search was not properly made] I hired attorney Will Bruzzo to represent me because of his experience with these types of cases and his experience with the local courts and District Attorney in Orange County. I was charged with falsely reporting a crime under Penal Code Section 148.5(a). There were some mitigating factors because I myself had been a victim of a violent crime. In addition, I would have lost my job had I been convicted of this crime. While the case was pending, I stupidly committed a fraud on the court, which made my situation worse and could have sent me to jail as well as caused me to lose my job. I was arrested for Domestic Violence under Penal Code Section 273.5(a) as a felony for an incident that occurred with my spouse in Orange County, California. My bail was set at $50,000.00. For the crime I was arrested for I faced a maximum of three years in prison. After I bailed out of jail I went to speak to Attorney William Bruzzo whom I understood to be a very effective attorney and very familiar with the judges and the District Attorneys in Orange County. Mr. Bruzzo told me that he would start working on my case even before my court date and that he would try to persuade the District Attorney NOT TO FILE the case against me which would mean there would never actually be a court case.
