How to End Probation Early in California Under Penal Code 1203.3

Law Offices of William W. Bruzzo

A California judge can end probation at any point during the term. The statute sets no waiting period, no eligibility list and no excluded offense. What it requires is a showing, and the court decides.

At the Law Offices of William W. Bruzzo, an Orange County criminal defense attorney builds that showing from the probation record rather than from the calendar.

What Does the Court Have to Find?

The test has two parts and both come from the statute. Penal Code 1203.3 lets the court end probation “at any time when the ends of justice will be subserved thereby, and when the good conduct and reform of the person so held on probation shall warrant it.”

Nothing in that section sets a minimum time served. The common claim that a year of a misdemeanor term or 18 months of a felony term must pass first appears nowhere in the code, though judges do want to see a real stretch of compliance.

What moves a judge is evidence. Clean testing, completed classes, restitution paid in full, steady work, and a reason the remaining supervision is getting in the way.

How Does the Motion Actually Work?

The statute sets out the procedure. A hearing “shall be held in open court before the judge,” the prosecutor gets “a two-day written notice and an opportunity to be heard,” and the court or clerk must give written notice to the probation officer first.

Note what the prosecutor gets, a say and not a veto. Nothing in the statute requires the prosecution to agree. One caution applies where restitution is outstanding, since the prosecutor must ask for a continuance if the victim reports an unpaid balance.

Is There a Form to File?

No Judicial Council form covers a motion to end probation early. The statewide petition for dismissal, form CR-180, lists Penal Code 1203.4 and related sections and never mentions 1203.3. Orange County publishes no form, no instructions and no fee for it either.

That makes it a noticed motion drafted by counsel and filed in the court that imposed the sentence. The same motion can ask for less, since the statute also allows a court to modify conditions, which opens the door to dropping one or moving from formal supervision to informal.

What Does Ending Probation Early Let You Do Next?

Early discharge opens the dismissal immediately. Penal Code 1203.4 extends relief to a defendant who “has been discharged prior to the termination of the period of probation,” which is exactly what a granted motion produces.

Orange County states the sequence the same way on its own record-clearing self-help pages, which direct a person still on probation to seek release first. One motion can move a case from active supervision to a cleared record years sooner than the sentence allowed.

Early termination is discretionary, so the record put in front of the judge is what decides it, and a motion filed too early is harder to bring back.
