DUI With a Commercial License: What Orange County CDL Holders Risk

California holds commercial drivers to a 0.04 percent blood alcohol limit, half the limit for everyone else, and a DUI conviction in any vehicle can disqualify a commercial license for a year. That includes your own car on a day off.

The Commercial Limit in California Is 0.04 Percent

California sets two separate alcohol limits for drivers. The familiar 0.08 percent figure comes from Vehicle Code Section 23152(b), while Section 23152(d) sets 0.04 percent for anyone driving a commercial motor vehicle. Section 23153(d) applies that same figure where an act or neglect of duty proximately causes injury.

Federal law uses the identical threshold. The disqualification rules at 49 CFR 383.51 list 0.04 or greater in a commercial vehicle among the major offenses, alongside driving under the influence and refusing a chemical test.

Can a DUI in Your Personal Vehicle Disqualify Your CDL?

A California DUI in a private car can disqualify a commercial license, and this is what drivers learn too late. Under Vehicle Code Section 15300, you may not operate a commercial motor vehicle for one year after a first conviction of Section 23152 in a vehicle of any kind. Hazardous materials extend that to three years, and under Section 15302, more than one conviction of a listed offense carries disqualification for life.

The offenses that can trigger disqualification include:

  • A first conviction under Section 23152 or 23153, in any motor vehicle.
  • Refusing or failing to complete a chemical test under Section 23612.
  • Hit and run involving a motor vehicle.
  • Driving a commercial vehicle on a revoked, suspended, or canceled license.
  • Vehicular manslaughter, or a fatality caused by negligent operation.
  • Using a vehicle to commit a felony.
  • Evading police under Sections 2800.1, 2800.2, or 2800.3.

Penalties also escalate on the criminal side for repeat DUI offenses in Orange County, and those run alongside the disqualification rather than replacing it.

Why a Commercial DUI Cannot Be Kept Quiet

Federal regulation blocks the workaround California drivers ask about first. Under 49 CFR 384.226, a state must not mask a conviction, defer judgment, or allow a license holder into diversion in a way that keeps a traffic conviction, in any vehicle, off the commercial driver record.

Employment reporting runs on its own track. A driver in prohibited status in the federal Drug and Alcohol Clearinghouse may not lawfully operate a commercial vehicle, and since November 2024 state agencies have had to start a downgrade rather than renew that license.

Two Proceedings Start at Once After an Orange County Arrest

An Orange County CDL arrest opens a criminal case and a licensing case at once, and neither waits for the other. Your criminal case is arraigned where the stop happened: Central in Santa Ana, Harbor in Newport Beach, North in Fullerton, or West in Westminster. The license side is administrative, with separate deadlines. The California DMV explains that a commercial license must be downgraded to a Class C noncommercial license before a restricted license can issue.
